Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Vela VPN application (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

We reserve the right to update these Terms at any time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

2. Description of Service

Vela VPN provides a Virtual Private Network (VPN) service that encrypts your internet traffic and routes it through our servers using the WireGuard protocol. The Service is available as a mobile application for Android, with iOS and desktop versions planned for future release.

The Service is offered in both a free tier (with monthly data limits) and premium paid plans. Features available to free and paid users are described in the app and on our website.

3. Account Registration

You must create an account to use the Service. You agree to:

• Provide accurate and complete registration information
• Keep your password confidential and not share your account credentials
• Notify us immediately at [email protected] of any unauthorized use of your account
• Be responsible for all activity that occurs under your account

You must be at least 13 years old to create an account.

4. Acceptable Use

You agree to use the Service only for lawful purposes. You may not use Vela VPN to:

• Engage in any illegal activity under applicable law
• Distribute malware, spyware, ransomware, or other malicious software
• Conduct denial-of-service (DoS/DDoS) attacks against any target
• Send spam, phishing emails, or unsolicited bulk messages
• Infringe on the intellectual property rights of others
• Harass, threaten, or harm other individuals
• Circumvent export controls or sanctions regulations
• Resell or redistribute the Service without our written permission

Users are solely and exclusively responsible for ensuring their use of Vela VPN complies with all applicable local, national, and international laws and regulations in their jurisdiction. Vela VPN, its owners, operators, and employees accept no liability whatsoever for any illegal activities conducted by users through the service. By using Vela VPN, you explicitly acknowledge that you are using the service for lawful purposes only, and you agree to indemnify and hold harmless Vela VPN from any claims, damages, or legal actions arising from your misuse of the service.

5. Free Plan

The free plan includes 5 GB of data per month, resetting on each user's signup-day anniversary. Free plan users have access to a shared Auto-Connect server and core security features including Kill Switch. Access to premium server locations, streaming servers, and split tunneling requires a paid plan.

We reserve the right to modify free plan limits or availability at any time.

6. Paid Plans and Billing

Paid subscriptions are billed in advance on a recurring basis (monthly, annually, or as specified). Prices are listed in USD and may vary by region.

• Renewal: Subscriptions renew automatically unless cancelled before the renewal date.
• Cancellation: You may cancel at any time through the app or by contacting support. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time.
• Refunds: We offer a 7-day money-back guarantee for new paid subscribers. Contact [email protected] within 7 days of your first payment to request a full refund.
• Price changes: We will provide at least 30 days' notice of any price increases.

7. Service Availability

We strive to maintain a highly available service but do not guarantee uninterrupted access. Vela VPN may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any downtime or service interruptions.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We operate a strict no-log policy — we do not store your browsing activity, IP addresses, or connection timestamps.

9. Intellectual Property

All content, trademarks, and software associated with Vela VPN are owned by or licensed to us. You are granted a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use. You may not copy, modify, distribute, or reverse engineer any part of the Service.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, uninterrupted, or meet your specific requirements. Use of the Service is at your sole risk.

11. Limitation of Liability

To the maximum extent permitted by law, Vela VPN shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Termination

We may suspend or terminate your account immediately, without notice, if you violate these Terms. You may also terminate your account at any time by contacting support. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be resolved through good-faith negotiation, followed by binding arbitration if necessary.
